GEM Terms of Service
Article 1 (Purpose)
① These Terms of Service define the rights, obligations, responsibilities, and other necessary matters between STAYGE Labs, Inc. (hereinafter referred to as the “Company”) and users (hereinafter referred to as the “Users”) regarding GEM used in connection with the Company’s LiNC service.
② Any matters not stipulated in these Terms of Service shall be governed by the LiNC Service Terms and Conditions (hereinafter referred to as the “LiNC Terms”).
Article 2 (Definitions)
① The definitions of the terms used in these Terms of Service are as follows:
1. "GEM" refers to an electronic certificate or related information issued by the Company for use in the LiNC service, which functions as an electronic payment method. The name may be subject to change at the Company’s discretion. The Company may issue separate dedicated vouchers depending on the type of service and operate them in accordance with the respective policies.
② Any matters not defined in these Terms of Service shall follow the definitions set forth in the LiNC Terms.
Article 3 (Purchase of GEM, etc.)
① Prior to the purchase of GEM by a user, the Company shall disclose the following matters in an appropriate manner through these Terms and within the service to ensure that the user can accurately understand the transaction conditions and complete the transaction without error or misunderstanding:
1. The seller’s trade name, representative’s name, address, telephone number, etc.
2. Details such as the identification and selection of GEM, selection of purchase method, input of payment information, confirmation of purchase application, types and prices, usage methods, timing of use, usage conditions, etc.
3. Matters concerning the withdrawal of offer, contract cancellation period, method of exercise and effect thereof, and refunds.
4. Matters concerning compensation for consumer damage, handling of complaints, and dispute resolution.
② The Company may reject, withhold approval of, or later cancel the user’s application to purchase a dedicated voucher (GEM) in any of the following cases:
1. If the applicant is not using their real name or is using another person’s name.
2. If false information is provided or required information is omitted.
3. If there is no availability in service-related facilities or there are technical or operational issues.
4. If the purchase is deemed to be fraudulent, such as mass purchases from the same IP, repeated purchases from similar IDs, or purchases from suspicious IP addresses.
5. If a minor under the age of 19 applies without the consent of their legal guardian.
6. If payment is not actually made or is unlikely to be made.
7. If the Company determines that the user’s application to purchase GEM may harm the interests of the Company or third parties.
③ The Company may change or discontinue the price and amount of GEM provided after giving prior notice to users. However, if such changes or discontinuations are disadvantageous to users, the Company shall notify them individually via electronic means such as in-service notices, email, direct messages, or consent pop-ups at login.
④ If a user, through no fault of their own, becomes unable to use GEM previously purchased under the conditions in place at the time of purchase due to the Company’s changes or discontinuation of GEM content, the Company shall provide appropriate compensation for the unusable portion.
Article 4 (In-App Purchase, IAP)
When a user purchases GEM through an in-app purchase (hereinafter referred to as “IAP”), they must follow the procedures required by the relevant app marketplace. The final amount charged for a GEM purchased via IAP can be confirmed in the payment screen of the app marketplace. Depending on the policies and criteria of the app marketplace, the user's monthly cumulative payment amount and the purchase limit for GEM may be restricted. If the applicable threshold is exceeded, additional use of GEM sold through IAP may become unavailable.
Article 5 (Refunds)
① If the user requests a refund for unused GEM that they have purchased, the Company may deduct a refund processing fee and issue the refund. However, if the refund is due to reasons attributable to the Company, the fee will not be deducted.
② The Company shall process the refund using the same payment method used by the user within three (3) business days from the date of the refund request.
③ Notwithstanding Paragraphs 1 and 2, in the case of IAP transactions, the Company shall request the app marketplace to take relevant actions such as suspending or canceling the payment, in accordance with applicable consumer protection laws related to electronic commerce. However, users are advised to refer to the policies of the relevant app marketplace for the outcome of such actions, as they are subject to the marketplace’s policies.
Article 6 (Statute of Limitations)
① If five (5) years have passed since the date of GEM purchase or recharge, the commercial statute of limitations shall be deemed to have expired, and the customer may no longer request provision of goods, refunds, or balance returns from the issuer. However, if the Company voluntarily allows continued use of GEM, the statute of limitations shall not apply.
② The statute of limitations mentioned in Paragraph 1 shall be calculated sequentially based on the date of purchase or recharge.
Article 7 (Responsibility of the Issuer)
① The Company shall bear ultimate responsibility for any user rights related to the use of GEM.
② If damage occurs to the customer due to data falsification or tampering, the issuer shall compensate the customer for the damage. However, the issuer shall not be liable if it proves that the damage was due to the user’s negligence in managing their information, or due to force majeure such as natural disasters.
Article 8 (Miscellaneous)
① The Company shall display the information specified in Article 4 of the Standard Terms and Conditions for New Types of Gift Certificates, as established by the Korea Fair Trade Commission, on the service page, customer center, etc.
② Any matters not specified in these Terms or any disputes regarding the interpretation of these Terms shall be resolved through mutual agreement between the user and the Company. If such agreement cannot be reached, the relevant matters shall be governed by applicable laws and regulations, including the Act on the Regulation of Terms and Conditions, the Act on the Consumer Protection in Electronic Commerce, the Electronic Financial Transactions Act, the Standard Terms and Conditions for Electronic Financial Transactions, the Framework Act on Telecommunications, the Telecommunications Business Act, the Specialized Credit Finance Business Act, and customary business practices.
③ Notwithstanding any other provisions of these Terms, some services provided through the iOS app may only be accessed through a dedicated voucher (hereinafter referred to as the "iOS App Exclusive Voucher") that can be purchased and used within the iOS app. Other matters regarding the purchase and use of the iOS App Exclusive Voucher shall be governed by these Terms to the extent applicable.
